Denial of landing grounds
The Excerpt from “Entry Procedures <Grounds for denial of landing (Article 5 of the Immigration Control and Refugee Recognition Act)>” described by the immigration Bureau of Japan is as below.
International law establishes the fundamental rule that a nation has the authority to prohibit entry by a foreigner when it deems said entry to be unbeneficial, as well as the authority to permit entry when it deems appropriate. Each country denies entry/landing of foreigners deemed likely to be harmful to the country’s public health, public order, domestic security, etc.
Landing is denied to foreigners for whom permitting landing would be unfavorable for Japan. Specifically, entry/landing is denied to the following types of foreigners:
- Those for whom permitting landing would be unfavorable from a standpoint of health/hygiene.
- Those for whom permitting landing would be unfavorable due to their strong antisocial nature.
- Those for whom permitting landing would be unfavorable because of past experience being deported from Japan, etc.
- Those for whom permitting landing would be unfavorable because they pose a threat to the interests or security of Japan.
- Those for whom landing cannot be permitted due to reasons of reciprocity.
入国拒否事由
国家は,その国にとって好ましからざる外国人の入国を禁じ又は適当と認める条件により入国を許可する権限を有することは国際法上確立した原則であり,各国とも公衆衛生,公の秩序,国内の治安等が害されるおそれがあると認める外国人の入国・上陸を拒否することとしています。
我が国にとって上陸を認めることが好ましくない外国人の類型が上陸拒否事由で,具体的には次のような類型の外国人が我が国への入国を拒否されます。
- 保健・衛生上の観点から上陸を認めることが好ましくない者
- 反社会性が強いと認められることにより上陸を認めることが好ましくない者
- 我が国から退去強制を受けたこと等により上陸を認めることが好ましくない者
- 我が国の利益又は公安を害するおそれがあるため上陸を認めることが好ましくない者
- 相互主義に基づき上陸を認めない者
